Abbott Laboratories Inc., Arriva Medical LLC, and Alere Inc. secured dismissal of a whistleblower’s False Claims Act suit alleging that the companies improperly billed Medicare for diabetic supplies, a federal district court said.
Troy Olhausen, who filed this suit in 2019, failed to satisfy the materiality element needed to raise a valid FCA claim, Judge Robert N. Scola Jr., of the US District Court for the Southern District of Florida said, granting the defendants’ motion to dismiss with prejudice.
