A False Claims Act whistleblower that accused Academy Mortgage Corp. of improperly originating loans insured by a federal agency is now entitled to $5.4 million following an April appeals court ruling, a federal district court said Monday.
Gwen Thrower is to receive that amount, instead of $8.7 million, in light of the US Court of Appeals for the Ninth Circuit’s conclusion the lower court inappropriately added a 1.75 multiplier to her fee and expense award, Judge Edward M. Chen of the US District Court for the Northern District of California said.
