Acadia Healthcare Co. Inc. will again face a whistleblower’s False Claims Act suit alleging that the company improperly billed federal health-care programs for treatment related to opioid use disorder, the Fourth Circuit ruled Monday.
Whistleblower Lisa Wheeler adequately alleged materiality under the FCA by arguing that the government wouldn’t have paid Acadia’s claims had it known the company wasn’t providing group therapy or adequate individual therapy, Judge Nicole G. Berner of the US Court of Appeals for the Fourth Circuit said, reversing a district court’s decision to dismiss the suit.
