A $2.3 million settlement in a False Claims Act case accusing a Texas acupuncturist of submitting inflated bills to the Department of Veterans Affairs is enforceable, the US Court of Appeals for the Fifth Circuit affirmed Monday.
A Texas federal district court reasonably concluded that the government and defendants orally agreed to the material terms of the settlement at mediation, Judge Stephen A. Higginson said.
The government in 2022 accused Dongxin Ma and Ma Acupuncture Center PC of improperly seeking payments from the VA, and receiving about $1.3 million to which they weren’t entitled.
