Alabama Hospice Providers Stop Whistleblowers’ Fraud Lawsuit - Bloomberg Law News

Alabama and Tennessee-based hospice services providers convinced a federal district court to dismiss whistleblowers’ claims they improperly billed Medicare, in violation of the False Claims Act.

Whistleblowers Brandy Bryant and Carol Blackwood raised claims that triggered the FCA’s first-to-file bar, which precludes a second-filed suit when a first-filed suit is pending, Judge Emily C. Marks of the US District Court for the Middle District of Alabama said.

Marks dismissed other counts in the complaint because the whistleblowers failed to show Comfort Care Hospice LLC and others submitted claims for payment to the government. Bryant and Blackwood can amend their claims ...
