Amedisys North Carolina LLC showed that a federal district court properly dismissed a False Claims Act suit alleging that the company fraudulently billed Medicare and Medicaid for hospice services, the Fourth Circuit said Friday.
Ganesa Rosales’ suit is barred by the FCA’s first-to-file bar, which precludes a suit when a related action is pending, Judge James Andrew Wynn of the US Court of Appeals for the Fourth Circuit said. Rosales based her suit on the same material elements of fraud found in an earlier-filed suit by another relator, Wynn said, affirming the lower court’s order.
