Ameripec wage-an-hour $473K class action settlement - Top Class Actions

Ameripec, a company specializing in the packaging of non-carbonated beverages, has agreed to pay a $472,500 settlement to end employee claims the company violated California employment law.

The settlement provides benefits to employees of Ameripec, divided into two classes — group of class members and Private Attorney Generals Act (PAGA) members — as the plaintiff filed both a class action and an action under PAGA.

Class members include all those individuals who were Ameripec non-exempt employees in California between Aug. 31, 2016, and May 29, 2019.

PAGA members are all individuals who worked as non-exempt employees of Ameripec between Aug. 31, 2019, and March 1, 2022.

Todd Martin filed the PAGA action against Ameripec on Nov. 18, 2020. The Ameripec wage-and-hour class action settlement explains the company allegedly violated California law regarding enforcement of PAGA and by failing to:

  • Pay minimum and overtime wages
  • Provide legally required meal and rest periods
  • Timely pay wages during employment and upon separation of employment
  • Provide accurate wage statements
  • Reimburse necessary business-related expenses

Class members will be eligible for a proportional amount of the $472,500 settlement.

The payment amount will be based on the total number of hours each class member worked compared to the total number of weeks worked by all class members.
