Anderson Brothers to pay nearly $1.3 million to settle claims it falsified quality test results - Brainerd Dispatch

MINNEAPOLIS — Brainerd-based Anderson Brothers Construction Company has agreed to pay $1,295,610 to resolve allegations it violated the False Claims Act and the Minnesota False Claims Act from 2017 through 2022, the U.S. Attorney’s Office in Minneapolis announced Friday, April 4.

In a news release, the U.S. Attorney’s Office said Anderson Brothers violated the federal and state acts by routinely and knowingly falsifying test results to make its paving material appear to be higher quality than it was and submitting those falsified results to the government in seeking payments for road paving in Minnesota.

The claims resolved by the settlement are allegations only and there has been no determination of liability, the U.S. Attorney’s Office reported.

In response to the news that Anderson Brothers Construction, one of Minnesota’s leading construction and paving companies, reached a no-fault agreement to resolve a governmental inquiry about its past testing protocols, President and CEO Terry McFarlin released the following statement:

“We’re pleased to have resolved the government’s concerns about our past testing protocols through a no-fault agreement. It lets us avoid the time, distraction and expense of lengthy government litigation and instead focus on taking care of our customers.

"This settlement does not affect our ability to serve our customers, take on new projects, or achieve our long-term goals; it represents about one-half of one percent of the value of the projects...
