Anthem Cos. is free of allegations that it owes employees overtime after the worker who filed the suit failed to disclose the wage-and-hour claims as part of her bankruptcy proceedings.
The suing employee didn’t disclose her claims against the Elevance Health Inc. subsidiary when she filed for bankruptcy in 2019, even though they had already accrued, and her amendment attempting to fix the issue was “vague, arguably inaccurate, and woefully inadequate,” the US District Court for the Southern District of Indiana said.
