Apple Employee files Privacy Lawsuit - LawyersandSettlements.com

An Apple employee has filed a PAGA lawsuit claiming the tech giant of spying on its workers via their personal devices and iCloud accounts.

Santa Clara, CAAn Apple employee has filed a California labor PAGA lawsuit accusing the tech giant of harmful workplace policies by spying on its workers and violating workers’ privacy rights via their personal iCloud accounts and non-work devices. This lawsuit isn’t the first complaint about Apple’s ability to access workers’ private information but it details how company policies can make you subject to surveillance.



PAGA Lawsuit

The lawsuit was filed December 2nd in state court under the California Private Attorneys General Act (PAGA) alleging three claims:

  • Speech suppression
  • Privacy Violations, Surveillance, and Forced Patronage
  • Wage Clawbacks

PAGA allows employees to sue on behalf of the state for labor violations. Apple could be forced to pay penalties for each violation multiplied by the number of employees affected if found liable. Under California law, for PAGA notices filed on or after June 19, 2024, 65 percent of the recovered penalties goes to the State and 35 percent to the aggrieved employees. The payout for California PAGA claims can be costly. Penalties include $100 for each aggrieved employee per pay period for initial violations and $200 for each aggrieved employee per pay period for subsequent violations.
