Ask the Governor: Murphy Noncommittal on NJDOL Independent Contractor Rule Proposal - New Jersey Business & Industry Association

Gov. Phil Murphy was noncommittal when asked about the chances of a controversial rule proposal by the state Department of Labor and Workforce Development that would drastically reduce the number of independent contractors in the state.

Speaking on News 12’s “Ask the Governor” on Thursday afternoon, Eric Landskroner read an X comment from Fight for Freelancers co-founder Kim Kaven that said:

“Nearly two dozen legislators on both sides of the aisle in Trenton have publicly expressed concern about NJDOL's proposed independent contractor rule, including it being outside of statute and case law. Why won't the governor rescind this deeply misguided proposal?”

“No decisions have been made yet,” Murphy told Landskroner. “It doesn't mean that we either endorse it or walk away from it.

“There's a good amount of debate. Very passionate. But this is not yet nearly in cement, and that's a process that will play out over the next few weeks.”

NJBIA and other business groups and independent contractors en masse have vehemently opposed the NJDOL proposal, as it would bring greater scrutiny to the ABC tests that determine whether a worker is an independent contractor or an employee.

The NJDOL proposal mirrors a California 2019 rule that left more than 100 exemptions in its wake, and also reduced the number of independent contractors and employees in the Golden State.
