Atlantic Home Health Care Settles Allegations of False Claims Act Violations for $10 Million - Medriva

In a significant legal resolution, Atlantic Home Health Care LLC, a home health care service agency operating across nine states including Arizona, has agreed to pay nearly $10 million. This settlement is to resolve allegations of violating the False Claims Act, as accused by the United States Government. The alleged violations include submitting false claims to the Energy Employees Occupational Illness Compensation Program (EEOICP) and making payments in the form of kickbacks.

The Allegations Against Atlantic Home Health Care

The company was accused of billing the EEOICP for in-home nursing and personal care services when its employees were not physically present in the patients’ homes. This program, administered by the Department of Labor (DOL), is established for the benefit of Department of Energy employees and contractors suffering from occupational illnesses. The alleged false billing took place between 2017 and 2021.

Moreover, the government alleged that Atlantic Home Health Care paid kickbacks for patient referrals and in-kind payments for food, internet, travel, and other expenses to patients and their families through its ‘friends and family program’. These accusations not only violated the False Claims Act but also raised serious ethical concerns about the company’s operations.
