Baker Hughes Oilfield Operations LLC won’t face reinstated Americans with Disabilities Act claims by a former employee because the arbitrator who dismissed the action didn’t exceed his authority.
Donald Kinsella alleged that the arbitrator improperly required discriminatory intent as an element of proof into his failure-to-accommodate claim.
But the argument “is based on a misunderstanding of this arbitrator’s treatment of discriminatory intent,” the US Court of Appeals for the Seventh Circuit ruled Monday in an opinion by Michael B. Brennan.
