Congress Passes Arbitration Carveout. In a rare moment of bipartisanship—particularly in the labor and employment policy sphere—the U.S. Congress this week passed the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act of 2021. The bill sailed through the U.S. Senate on a voice vote on February 10, 2022, after passing the U.S. House of Representatives earlier in the week by a vote of 335–97. The bill would prohibit any “predispute arbitration agreement or predispute joint-action waiver” relating to a “sexual assault dispute” or “sexual harassment dispute.” President Biden is expected to sign the bill into law shortly. The new law “shall apply with respect to any dispute or claim that arises or accrues on or after the date of enactment of [the] Act.” Ron Chapman, Jr., Christopher C. Murray, and Hera S. White House Union Task Force Issues Report. The White House Task Force on Worker Organizing and Empowerment finally released its report this week. Created by President Biden’s similarly named executive order, the task force was instructed to “identify statutory, regulatory, or other changes that may be necessary to make policies, practices, and programs more effective means of supporting worker organizing and collective bargaining.” Primarily focused on administrative and regulatory policy changes, the report contains nearly seventy recommendations for President Biden, including the following:
