A Black man who said race bias drove his firing as an UPS on-road supervisor after he tested positive for cocaine lacks proof warranting a trial.
Kendrick Langley failed to identify a comparable White United Parcel Service Inc. employee who engaged in similar misconduct yet kept their job, the US Court of Appeals for the Third Circuit said Wednesday.
The unpublished decision, which affirmed a trial court ruling, illustrates that workers who hold higher-ranked jobs than an employee suing for employment discrimination generally aren’t valid comparators for evidentiary purposes.
