In an educational video presentation published by the Coalition of Oklahoma Breastfeeding Advocates (COBA), McAfee & Taft labor and employment attorney Paige Good was featured in its “Know Your Rights” segment. She discussed the federal and state laws that provide protections for nursing employees in the workplace.
“The Fair Labor Standards Act is a federal law that applies to most private and public employers throughout the United States.
“In late 2022, it was expanded by a new law called the Providing Urgent Maternal Protections for Nursing Mothers Act, otherwise referred to as the PUMP Act. This law requires employers to provide reasonable break time throughout the workday for nursing employees to express breast milk for their nursing child for one year following the child’s birth, each time the employee needs to. Employers are also supposed to provide a place other than a bathroom, shielded from view and free from intrusion from coworkers, which may be used for pumping. Essentially, with some exceptions, the PUMP Act requires reasonable break time and a private space to pump at work.
“The Pregnant Workers Fairness Act, the PWFA, also recently became law. This law applies to both private and public sector employers, like state and local governments, that have 15 or more employees.
