Can I leave work to go vote? Does my employer have to let me leave my job to vote? - AL.com

Alabama law requires employers to give workers time off to vote. But there are some restrictions to that requirement.

The law states employees have to provide “reasonable notice” to take “necessary time off to vote” in any city, county, state or federal political party primary or election, as long as the worker is qualified and registered to vote on the day the election takes place.

Employers are only required to provide one hour off. They aren’t required to give time off if an employee’s start time is at least two hours after polls open (polls open at 7 a.m. in Alabama) or ends at least an hour before the polls close (polls close at 7 p.m. in Alabama). In other words, if a person’s job doesn’t start until 9 a.m. and ends by 6 p.m., time off from a job isn’t required. And anyone in line by 7 p.m. must be allowed to vote.

The employer can also specify what time period will be provided for voting.

Employers are not required to pay workers for time off to vote.

Alabama is one of 28 states and Washington, D.C. that requires businesses to give their employees time off during work on election day. Seven of the states, including Alabama, do not mandate paid time off for voting.
