B & G Machine, Inc. is entitled to summary judgment on a 73-year-old company president‘s claim alleging discrimination in violation of the Age Discrimination in Employment Act because he was terminated after a diligence assessment, a federal district court in Delaware ruled. The court found that the chief operating officer’s comments stating that the company’s leadership needs “runway behind them” when the company sells and his multiple comments regarding its need for “new blood” were stray remarks.
