A federal district court granted Texas Farm Bureau’s motion for summary judgment on an age discrimination claim under the Age Discrimination in Employment Act and the Texas Commission on Human Rights Act of a 58-year-old job applicant who alleged that he wasn’t hired for a sales representative position due to his age. The hiring manager voicing his concern about the applicant’s age showed discriminatory animus, and the applicant made a prima facie case showing that he was qualified for the position, the court said.
