Wal-Mart Stores East, LP is entitled to summary judgment on an assistant store manager’s race discrimination claim under Title VII of the Civil Rights Act and 42 U.S.C. § 1981, a federal district court in Mississippi ruled. Her position was allegedly eliminated as part of a reduction in force. She established a prima facie case of race discrimination, the court said, because she claimed that she was replaced by a white employee, and that her poor performance evaluation and disciplinary actions were imposed against her in a discriminatory fashion.
