A California federal district court denied motions to dismiss by SpyGlass and an employee on claims of breach of contract, fraud, breach of duty of loyalty, and Computer Fraud and Abuse Act violations brought by Glaukos Corporation against its former senior director of clinical research who allegedly downloaded over 11,000 confidential documents before joining competitor SpyGlass, finding that Glaukos adequately pleaded all claims including that the director breached his employment agreement and duty of loyalty by soliciting employees and accessing confidential information for his new employer’s benefit.
