On remand from the Third Circuit, a federal district court in Pennsylvania granted the Borough of Worthington summary judgment on two former borough police officers’ procedural due process, Pennsylvania Whistleblower law, and tortious interference with employment claims arising from their termination without notice or pre-termination hearings. The Borough of Worthington argued that both officers lacked a protected property interest in their employment under either the Pennsylvania Police Tenure Act or the Borough Code, because three of the four officers on the local force worked less than a 30-hour week, and neither of the two officers were “regular full-time police officers” ...
