Case: Individual Employment Rights/First Amendment (C.D. Ill.) - Bloomberg Law

Macon County and the former Macon County State’s Attorney are entitled to summary judgment on the retaliatory discharge, Illinois Whistleblower Act and First Amendment retaliation claims of two discharged State’s Attorney’s Office employees, a federal court in Illinois ruled. The court found the employees failed to support that they were employed or jointly employed by the County—as the State’s Attorney’s Office is part of the judicial branch—and it declined to consider the retaliatory discharge and whistleblower claims predicated on an employment relationship. Their First Amendment claim also fails as they haven’t identified any unconstitutional county policy which caused them harm ...
