A federal district court found that the Biloxi Public School District wasn’t entitled to summary judgment on an administrative assistant’s First Amendment retaliation claim alleging that she was terminated for reporting illegal financial activities to the school board and the Mississippi Office of the State Auditor. The court classified her letter reporting the alleged misappropriation of funds to the school board as mixed speech because although she learned of the conduct through her employment, writing the letter wasn’t part of her job duties and its reproduction in the media supports her claim that it involved a matter of public concern. ...
