A federal district court in Florida denied the city of Opa-Locka’s motion to dismiss a police captain’s First Amendment retaliation claims. He alleged that the city violated his constitutional rights when it placed him on administrative leave, decreased his pay and demoted him in retaliation for objecting to the city’s alleged financial mismanagement and waste of public funds. The court found that because his job duties didn’t include financial management, he plausibly alleged that he made the complaints as a citizen on a matter of public concern.
