CSX Transportation, Inc. isn’t entitled to summary judgment on the Federal Rail Safety Act claim of a car inspector who alleged he was assessed a disciplinary rule violation and suspended for three days in retaliation for his reporting a defective railcar during a brake inspection at a rail yard. As a result of his identifying the unsafe railcar, the train to which it was connected was delayed two hours while a crew removed it from the tracks, the court stated.
