On remand from the Third Circuit, the NLRB determined that certain schedules and attachments included in an asset purchase agreement, which were unlawfully denied to a union representing hospital employees in response to its information request, are presumptively relevant for the proper performance of the union’s bargaining duties related to the effects of the sale of assets to a holding company, such as information concerning unit employees’ wages, conditions of employment, benefits, and potential layoffs.
