Case: Wage & Hour/Collective Action (S.D.N.Y.) - Bloomberg Law

The city of New York is granted partial summary judgment on a collective action claim alleging unpaid overtime in violation of the Fair Labor Standards Act on behalf of a class of over 2,000 workers based on the alleged miscalculation of the non-exempt employees’ regular rate of pay, a federal district court ruled, where damages experts dispute if the correct number of differential hours were used to calculate certain opt-in plaintiffs regular rates of pay and overtime rates from 2015 to present.
