The Gap, Inc. is denied summary judgment on a diabetic employee’s Family Medical Leave Act interference claim after he was fired for excessive unexcused absences, a federal court ruled, where questions remain whether he provided a note from his doctor addressing his medical need for social distancing, and a jury could find that his supervisor didn’t make him submit medical documents to support his requested leave or that his doctor provided it but didn’t remember or update his medical chart.
