Case: Wage & Hour/Overtime (D. Conn.) - Bloomberg Law

CareOne Health Services, LLC isn’t entitled to summary judgment on three former personal care assistants’ collective claims of failure to pay overtime under the Fair Labor Standards Act and the Connecticut Minimum Wage Act, a federal district court in Connecticut ruled. The in-home personal care assistants alleged that CareOne failed to properly compensate them for overtime hours worked, including time their sleep was interrupted by elderly clients’ needs. The court found genuine disputes of material fact exist regarding their overtime compensation, with respect to the overtime work they indisputably performed and the alleged work they performed during sleep periods.
