A federal district court in Nevada denied summary judgment to police officers in the Metro K-9 unit of the Las Vegas Metropolitan Police Department, seeking unpaid pension contributions, unpaid overtime, and assignment differential pay under a collective bargaining agreement, the Fair Labor Standards Act and Nevada law for their off-duty responsibilities as patrol service dog “handlers.” The court ruled that according to the plain language of the CBA, K-9 pay is overtime pay, rather than compensation, and the handlers weren’t entitled to pension contributions for their K-9 overtime pay.
