A federal district court in New Jersey granted a motion for class certification by a former waitress who alleged that Adelphia Three Corp deprived her and other tipped employees of their applicable minimum wage and overtime pay by taking a “tip credit” without providing them with adequate notice under the New Jersey Wage and Hour Law. A class of tipped employees could be easily ascertained, there were more than 40 class members to meet the Rule 23 numerosity requirement, and judicial efficiency weighed in favor of certifying the class, the court noted.
