Case: Wage & Hour/Proposed Settlement (S.D.N.Y.) - Bloomberg Law

A federal district court declined to approve a joint proposed settlement agreement addressing Wingate of Dutchess, Inc.’s alleged violations of the Fair Labor Standards Act and New York Labor Law, concluding the agreement contains an impermissible non-solicitation provision. The court stated that the provision’s language requiring the plaintiff not to voluntarily participate in lawsuits asserted by any person against Wingate of Dutchess would effectively bar her from cooperating with other claimants, which is the type of chilling provision courts routinely reject in FLSA settlements.
