The Supreme Court of Nevada affirmed the district court’s dismissal of a putative class action brought by construction workers against Apex Materials, as well as the company’s contractors and subcontractors, for unpaid prevailing wages and overtime under Nevada’s prevailing-wage statute, holding that the statute does not provide a private right of action outside the administrative process and workers must first exhaust administrative remedies through the labor commissioner before seeking judicial review.
