The Secretary of Labor’s motion to alter judgment is granted, and judgment is entered in the amount of $49,200.23 on behalf of 31 current and former tipped servers and baristas of Longbranch Café and Bakery alleging violations of the Fair Labor Standards Act, a federal district court in Illinois ruled. A jury found the café required its tipped employees to participate in a tip pool including non-tipped employees and it failed to pay its employees the minimum wage required by law. A jury verdict awarding the employees back pay in amount of of $4,920.22 constitutes manifest error, the court said. ...
