2023 will see a number of significant changes in Polish labour law. Many of them have been widely expected, both by the employees and the employers, as they were supposed to be enacted still in 2022. Below is a brief summary of the most important changes in Polish labour law that may take place in 2023, along with recommended actions to adequately prepare for them by implementing the relevant organizational tools. At the time of this writing we are not aware of the fixed effective dates of most of the proposed changes, but, given their relatively large number, we would like to draw your attention to them now so that you can take the necessary measures to adapt your work processes to the new legal requirements well in advance.
Minimum wage
The minimum wage will increase twice in 2023. The minimum rates will be in effect from January to June, and then from July to the end of 2023. The minimum wage rates for 2023 are as follows:
An increase in the minimum wage rates will not only affect the basic remuneration, but also other employment-related entitlements, the amount of which depends on the minimum wage.
This applies in particular to:
- night time allowance,
- remuneration for downtime,
- the maximum amount of severance payment for termination of the employment relationship for reasons not attributable to the employees,
- compensation for violation of the principle of equal treatment in employment or mobbing
