BOSTON — The First Circuit upheld a summary judgment in favor of a Chinese life sciences company’s former employee, which the firm accused of violating a non-compete agreement. Under Chinese law, non-compete agreements are only enforceable against senior management, technical personnel and those who have access to trade secrets. In this case, “there is not a scrap of evidence” that the low-level sales assistant met that definition.
