Back wages totaling $270,000 were recovered by the US Department of Labor following an investigation into Cilantro Five Points in East Nashville.
Investigators with the department's Wage and Hour Division found that the restaurant violated the Fair Labor Standard's Act's minimum wage and overtime requirements, according to a news release. Eighty-two employees will benefit from the wage recovery.
The news release also said the Nashville business illegally required servers to share tips with dishwashers (specifically $5 per night on Fridays and Saturdays), failed to properly pay overtime and neglected to pay some workers the proper minimum wage for all hours in a workweek.
“Restaurant industry employees work hard for their wages, especially for the tips they earn for good customer service. They depend on these tips to help make ends meet,” said division director Lisa Kelly. “By federal law, tips belong to the people who earned them, and employers are prohibited from withholding or redirecting these earnings.”
The findings of this investigation follows a March case involving Coco's Italian Market and Restaurant, resulting in the redistribution of back wages totaling $82,059 to 23 employees, the release said.
