ClubsNSW litigation: Whistleblower Troy Stolz to ask for contempt proceedings brought against him to be permanently stayed. - WAtoday

Terminally ill whistleblower Troy Stolz will ask the Federal Court on Friday for contempt proceedings brought against him by his former employer ClubsNSW to be permanently stayed on the grounds they are an abuse of process.

ClubsNSW has launched criminal contempt proceedings against Stolz over an interview he gave to YouTuber Friendlyjordies from his hospital bed in July, while he was receiving treatment for bone cancer. In the interview, he accused ClubsNSW of using the court system to drain him of money, which the organisation claimed had breached a court order not to “intimidate, harass or otherwise bring improper pressure” against it.

But when the matter returns to court on Friday his lawyers are expected to argue that material has come to light showing ClubsNSW is bringing its contempt action to intimidate Stolz into dropping his employment and workers’ compensation claims against the organisation, and improperly bringing criminal charges to discourage him from making public comments.
