Wage and hour laws for nursing home workers and CNAs: who’s affected
Are you a Certified Nursing Aids (CNA) or do you work at an elder care facility or nursing home? Have you been forced to work off the clock without overtime pay?
Labor laws help ensure nursing home staff and CNAs have a working environment that helps them do their job well. However, some nursing employers may be violating the law regarding overtime. This means that some workers may not be getting paid as much as they should.
The Covid pandemic is placing tremendous societal pressure on the medical industry. No one felt that pressure more than healthcare workers. Two-thirds of health staff have experienced burnout, more than 57% said they regularly worked over their contracted hours and 14% said they put in extra hours every shift.
This pressure extends beyond hospitals and into nursing homes, where “staff report high levels of post-traumatic stress, mood disturbance and moral injury during the pandemic,” reports a study published in the International Journal of Geriatric Psychiatry.
Given the toll placed on the industry, it’s important that individual healthcare workers are compensated fairly.
Despite regulations at both the state and federal levels, organizations haven’t always followed the law regarding nurse compensation. These violations have spurred nursing home wage and hour lawsuits, which have often resulted in multimillion-dollar settlements in favor of workers.
