The former chief of staff for the Cobb Sheriff’s Office has been found guilty of lying to police about being in a hit-and-run in 2023.
Braxton Tyree Cotton, 44, of Mableton, was found guilty of two counts of making a false statement as well as falsifying and concealing a material fact, Cherokee County District Attorney Susan Treadaway announced Friday.
Superior Court Judge Angela Brown sentenced Cotton, as a first offender, to five years, with the first six months in confinement and the remainder to be served on probation, according to the Cherokee DA’s office.
Cotton was also initially charged with criminal attempt to commit insurance fraud, criminal attempt to commit a felony and two counts of violation of oath by a public officer, but was acquitted of those charges by the jury Friday.
Since July 2023 — when the Cobb County DA’s office requested a substitute prosecutor for Cotton’s case — Treadaway’s office has led the prosecution in Cobb Superior Court.
“Occasionally there are circumstances which require the investigating agency, assigned judge or prosecutor to recuse themselves from participation in a case,” Treadaway said. “...This decision was made to ensure fairness and impartiality in the proceedings.”
In March 2023, Cotton — then major and chief of staff — reported a hit-and-run involving an unidentified driver who rear-ended his white Chevrolet Corvette, according to the DA’s office.
