'Commissions are Wages': NJ High Court Reinstates Employee's $1.3M Suit Against Company - Law.com

A unanimous New Jersey Supreme Court decision Monday strengthened protections for workers in finding that commissions are always classified as wages, allowing employees expanded recovery under the Wage Payment Law.

The March 17 ruling marked a decisive victory for plaintiff Rosalyn Musker, who has been battling her former employer over $1.3 million in unpaid commissions since September 2020. Both the Bergen County Superior Court and the Appellate Division sided with the software sales company, Suuchi, that because Musker received a base salary, commissioners were considered supplementary incentives—not wages.
