Conco Nixes Construction Worker's Would-Be Class Pay, Break Suit - Bloomberg Law

A commercial contractor won its bid to dismiss a proposed class action brought by a construction worker in California for various state wage and hour violations, after a district judge ruled the claims were preempted by federal labor law.

The labor agreement between Conco Cos. and the workers’ union directly addresses wages, hours, and work conditions, and expressly provides for overtime premiums, meal and rest breaks, and a base pay rate that exceeds the minimum wage, Judge Laurel Beeler said.
