A company building a large petrochemical facility in Beaver County has agreed to settle a class action lawsuit over alleged overtime violations for $38.5 million.
The settlement, which a state court approved late last month, comes in the face of numerous “hotly-contested” open questions about what can be considered compensable under the Pennsylvania Minimum Wage Act following the state Supreme Court’s high-profile decision last year in Heimbach v. Amazon.
