Major cold medicine manufacturers including Procter & Gamble Co., Bayer HealthCare LLC, and Johnson & Johnson Consumer Inc. who sold allegedly ineffective decongestants containing phenylephrine as “maximum strength” must face a consumer class suit, following a federal appeals court ruling Thursday.
Neither the drug monograph for the decongestants nor federal regulations addressed claims of comparative strength so the lower court improperly dismissed those claims, the US Court of Appeals for the Second Circuit said.
