Contractors' Suit Over Solicitation Phone Calls Given New Life - Bloomberg Law

A lawsuit filed by 51 home improvement contractors alleging that GoSmith Inc. made unsolicited phone calls to them offering information about potential clients in violation of the Telephone Consumer Protection Act was revived by a federal appeals court Wednesday.

A district court held that the contractors lacked standing to bring lawsuits under the TCPA because the statute was intended to protect individuals rather than businesses. A divided US Court of Appeals for the Ninth Circuit disagreed, holding that the statute by its plain language covered businesses as well as individuals.
