Court Allows New Jersey to Mandate Equal Pay for Temp Work (1) - Bloomberg Law

New Jersey’s one-of-a-kind law requiring that temporary workers be paid the same as their traditional employee counterparts will take effect Aug. 5 after surviving an initial court challenge.

A federal judge found that the business groups suing to block the law as unconstitutional aren’t likely to win their case, denying their request for an emergency injunction late Wednesday.

The New Jersey Staffing Alliance, American Staffing Association, and New Jersey Business and Industry Association claimed the law violates the dormant Commerce Clause and is unconstitutionally vague.
