The Civil Court has ordered a beauty clinic and a doctor to pay a customer 20,000 baht in compensation after ruling that part of its advertising for acne scar treatment was false.
In its ruling yesterday, the Civil Court's Consumer Case Division found that the claims saying Platelet Rich Plasma treatment (PRP) was equivalent to stem cell therapy in treating acne scars were false.
The lawsuit was filed by a customer who alleged the clinic made misleading claims about its acne scar treatment.
The ruling was based on testimony from a medical expert for the plaintiff, who said there was no recognised medical evidence showing that PRP treatment produces the same results as stem cell therapy.
Although the plaintiff was unable to prove the extent of the damage suffered, the court awarded 20,000 baht in compensation. It ordered the clinic and the specialist to jointly pay the plaintiff plus annual interest of 5%.
The court also ruled that the clinic's claim describing the doctor who provided the treatment as a specialist was not accurate because she was a general practitioner.
In the same case, the court said that claims describing the treatment as providing permanent, scar-free results were exaggerated but did not amount to deceptive advertising.
According to the court, consumers would understand that medical procedures inevitably cause wounds and that the human body changes over time, making permanent results impossible to guarantee.
