Court grants summary judgment in employment termination dispute - Missouri Lawyers Media

The U.S. District Court for the Eastern District of Missouri was asked to weigh whether summary judgment was warranted after an employee sued her former employer for alleged violations under the Americans with Disabilities Act.

Troy Covington was an employee of Bi-State Development Agency of the Missouri Illinois Metropolitan District as a transit service manager/dispatcher. She was hired by the agency in 2018 and fired in 2022.

Covington “has been diagnosed with a gastrointestinal condition called ‘dumping syndrome’ — symptoms include fatigue, acute gastrointestinal distress and frequent bathroom needs. She has also been diagnosed with postprandial diarrhea, nausea, insomnia, hypertension and colitis,” according to background listed in court documents.

In 2022, Covington submitted an ADA accommodation form to Bi-State requesting extra bathroom breaks and accommodations to attend doctors’ appointments. The court notes that the form did not request leave from work or a reduced schedule.

From February 2020 through October 2022, Covington was absent from work 140 times, according to the court. This included both excused and unexcused absences.
