Former and current tipped employees of the Cracker Barrel Old Time Country Store obtained conditional class certification and can proceed with their Fair Labor Standards Act suit.
The four employees allege that Cracker Barrel failed to pay tipped employees minimum wage for performing non-tipped work.
They also say that the company failed to pay them for “off the clock” work and didn’t inform them of tip credit requirements under the law.
In response, Cracker Barrel sought to dismiss the complaint and argued that the employees were subject to an arbitration agreement they signed as part of training.
